This position can be based in our office in Buenos Aires, Argentina, São Paulo , Brazil or Mexico City, Mexico.
Under direction of Head of ICO ComOps / ComDev, provide comprehensive legal counsel and support for CSL Behring’s Intercontinental commercial operations (ICO), particularly Eastern and Continental (ECI, including Switzerland) and Latin America (LATAM) commercial operations, including :
Responsibilities & Accountabilities :
Review, draft and negotiate all contracts required by the commercial operations function for all ICO functions, partnering with legal colleagues to provide outstanding customer service;
Review, draft and negotiate product high-value purchase, sale, distribution, and related agreements; advertising agency agreements;
Provide legal support regarding cooperation with Universities, Consultant-, Collaboration Agreements (excluding R&D agreements)
Advise clients on legal issues related to commercial activities, including public health insurance and reimbursement.
Provide legal support for promotional material review process.
Supervise and manage litigation and litigation exposure to protect the interests of CSL Behring’s operations and business services, in consultation with the Head of ICO ComOps / ComDev.
Learn, become familiar with, and stay informed on relevant legal and health care issues in order to proactively inform clients and help them anticipate and prepare for changes in the health care environment that may materially impact the business.
Partner with the Compliance Department to help ensure business processes and activities are and remain in compliance with applicable laws, regulations, and company policies, and to maintain open and effective avenues of communication among Legal, Compliance, and the business.
Collaborate with Legal Services , serve as an escalation point for Legal Services in relation to agreements within their area of responsibility that are required by the CommOps / CommDev functions.
Support related client groups including Commercial Development and Corporate Communications, including coordinating legal advice on a global basis.
Develop and deliver training on legal matters as required or requested.
Coordinate work with outside counsel as appropriate or assigned.
Establish and build good working relationships with internal clients based on mutual trust and respect and knowledge of the company’s business and its needs and goals
Job Specifications : Education :
Fully qualified lawyer (Master of Law)
Admission to local Bar
Minimum of 5 years of relevant professional experience, knowledge of and in depth experience (in-house) within the life science industry preferable.
Fluent knowledge (verbal and written) and use of Spanish, Portuguese and English, also in legal context; additional language.
Special knowledge in Contract, Unfair Competition, Social Security and Pharmaceutical Law and related compliance aspects.
